29 CFR 1926.451(f)(3): Scaffolds and scaffold components shall be inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity.   a. On or about March 30, 2015 located at 239 Evergreen Court in Pickerington, Ohio, employees were performing masonry work from a Titan fabricated frame scaffold system. The scaffold inspection conducted by the employer was not adequate to identify missing safety pins, missing guardrails, and an obstructed scaffold access ladder. The condition of the scaffold could affect the stability and safe use.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold.   29 CFR 1926.451(g)(1)(vii): For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee shall be protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.  a. On or about March 30, 2015 located at 239 Evergreen Court in Pickerington, Ohio, employees were working from the side brackets of a Titan fabricated frame scaffold. The scaffold platform did not have guardrails on the ends and adequate guardrails secured to the scaffold at the rear, thereby exposing employees to a maximum fall hazard of approximately 14 feet.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   a. On or about March 30, 2015 located at 239 Evergreen Court in Pickerington, Ohio, employees were performing masonry work from an eight on twelve pitched porch roof of a residential house without fall protection, exposing employees to a fall hazard of approximately 10 feet.
