29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:       a)  On or about March 31, 2015, the employer did not have a lock out program for the control of the hazardous energy, which includes machine specific procedures, training, and periodic inspections, while performing maintenance/servicing and set up on machines such as, but not limited to, the tear down saw.  Failure to lock out these components while these tasks are being performed exposes employees to amputation hazards.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    a)  On or about March 31, 2015, the employer did not assure that employees who operate the Clark and Caterpillar forklifts completed a training program and received a performance evaluation.  The employees use the lifts to carry pallets throughout facility.

29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been  taken out of service until restored to safe operating condition(s):    a)      On or about March 31, 2015, the employer did not assure the Clark forklift was removed from service during a time in which it was in need of repair.  Employees were exposed to injuries related to unsafe operating conditions in that the horn and back up alarm were not functioning.        b)      On or about March 31, 2015, the employer did not assure the Caterpillar forklift was removed from service during a time in which it was in need of repair.  Employees were exposed to injuries related to unsafe operating conditions in that the propane tank was not secure to the back of the lift.

29 CFR 1910.178(q)(7): Industrial trucks were not examined before being placed in service:    a)  On or about March 31, 2015, the employer did not assure the forklifts were examined for conditions that adversely affect the truck's safety before being placed into service.  The Clark lift truck was not in a safe operating condition in that the horn and back up alarm were not operative, preventing the operator from alerting pedestrians.        b)  On or about March 31, 2015, the employer did not assure the forklifts were examined for conditions that adversely affect the truck's safety before being placed into service.  The Caterpillar lift truck was not in a safe operating condition in that the propane tank on the back was not strapped down which could result in a propane leak or fire if it were to fall off of the lift.

Employees' hands were within several inches of the machine's blade while operating the saw exposing them to amputation hazards.
