29 CFR 1910.106(e)(6)(i): Adequate precautions were not taken to prevent the ignition of flammable vapors from sources such as open flames; lightning; smoking; cutting and welding; hot surfaces; frictional heat; static, electrical, and mechanical sparks; spontaneous ignition, including heat-producing chemical reactions; and radiant heat: Employees working in the paint mixing room were exposed to explosion hazards in that air conditioner motor was not explosion proof. Employees were working with category 3 flammable liquids, such as 92991 Hardener Fast, 92953 HS Hardener Normal, 92951 HS Hardener Fast, LV Med Hardener, 929-30 Low VOC Slow Hardener.

29 CFR 1910.134(e)(1): The employer shall provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace. The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator. 29 CFR 1910.1200(j)(1): The employer did not train employees regarding the new label elements and safety data sheets format by December 1, 2013. Employees were exposed to chemicals such as 92991 Hardener Fast, 92953 HS Hardener Normal, 92951 HS Hardener Fast in that the employer did not train employees on the portion of the hazard communication program that explains the new labeling on shipping containers and the safety data sheets and the order of information and how the employee could obtain and use the hazard information.
