29 CFR 1915.71(j)(1): Scaffolding, staging, runways, or working platforms which are supported or suspended more than 5 feet above a solid surface, or at any distance above water, were not provided with a railing, which had a top rail whose upper surface was from 42 to 45 and was not provided with a railing which had a midrail located halfway between the top rail and the staging, platform, or runway. USNS Mercy aft starboard ballast tank: On or about April 1, 2015 and times prior thereto, the hanging scaffold lower section of the tank the top rail measured at 38 inches and mid rail in section 83 was at 12 inches. Also, the deflection of the wire rope was over 10 inches. This exposed employees to an eight foot fall to the metal deck below.

29 CFR 1915.56(b)(4): Welding cable in poor condition was used. (a) USNS Mercy inside ballast tank: On or about April 1, 2015 and times prior thereto, a welding cable had a cut to the conductor. This exposed employees to potential shock hazard if they contacted conductor while welding. (B) USNS Mercy outside ballast tank: On or about April 1, 2015 and times prior thereto, a welding cable had a cut to the conductor. This exposed employees to potential shock hazard if they contacted conductor while welding. Vigor Marine was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1915.56(b)(4), which was contained in OSHA inspection number 834244, citation number 1, item number 1 and was affirmed as a final order on April 1, 2013, with respect to a workplace located at Portland OR.
