29 CFR 1926.651(j)(2): The employer does not protect each employee by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:      (a) Peachmont Farms, Marburger Road, Evans City, PA 16033: The employer does not ensure that each employee working in a trench is protected by keeping excavated material at least two feet from the edge of the upstream right lateral trench. This violation was documented on March 30, 2015 at a site located at Peachmont Farms, Marburger Road, Evans City, PA where employees were working in a 13 foot deep trench where spoil material was placed within two feet of the edge of the trench. To abate this violation the employer must ensure that each employee in a trench is protected by keeping excavated material at least two feet from the edge.     (b) Peachmont Farms, Marburger Road, Evans City, PA 16033: The employer does not ensure that each employee working in a trench is protected by keeping excavated material at least two feet from the edge of the upstream right lateral trench. This violation was most recently observed on March 31, 2015 at a site located at Peachmont Farms, Marburger Road, Evans City, PA where employees were working in a 13 foot deep trench where spoil material was placed within two feet of the edge of the trench. 29 CFR 1926.652(a)(1): The employer does not ensure that each employee in an excavation is protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:    (a) Peachmont Farms, Marburger Road, Evans City, PA 16033: The employer does not ensure that each employee working in a trench excavation is protected from cave-ins by an adequate protective system. This violation was documented on March 30, 2015 at a site located at Peachmont Farms, Marburger Road, Evans City, PA where employees were working outside of an inadequate protective system in a 13 foot deep trench to install mainline and lateral sanitary sewer lines. To abate this violation the employer must ensure that each trench over 5 feet in depth is provided with an adequate protective system to protect employees from the hazard of cave-in.      (b) Peachmont Farms, Marburger Road, Evans City, PA 16033: The employer does not ensure that each employee working in a trench excavation is protected from cave-ins by an adequate protective system. This violation was most recently observed on March 31, 2015 at a site located at Peachmont Farms, Marburger Road, Evans City, PA where employees were working outside of an inadequate protective system in a 13 foot deep trench to install mainline and lateral sanitary sewer lines. This violation was documented on March 30, 2105 at a site located at Peachmont Farms, Marburger Road, Evans City, PA where employees were working 4-5 feet below the bottom of the trench shield. To abate this violation the employer must ensure that each selected trench shield be installed within 2 feet of the bottom of the trench.       (b) Peachmont Farms, Marburger Road, Evans City, PA 16033: The employer does not ensure that each employee working in a trench excavation is protected from cave-ins by maintaining material at a level no greater than 2 feet (.61m) below the bottom of a shield. This violation was most recently observed on March 31, 2015 at a site located at Peachmont Farms, Marburger Road, Evans City, PA where employees were working 4-5 feet below the bottom of the trench shield.
