29 CFR 1910.146(d)(2): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not identify and evaluate the hazards of permit spaces before employees entered:  a)  Baler Area - The Employer did not identify and evaluate the hazards of the Fluffer Baler, a permit required-confined space before an employee unclogged jams through the access door with a metal pole.  On March 20, 2015, falling debris of books and paper inside the permit-required confined space trapped an employee's hand and engulfed an employee while attempting to unclog the Fluffer Baler.

29 CFR 1910.146(d)(3): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not develop and implement the means, procedures, and practices necessary for safe permit space entry operations:  a) Baler Area - The employer did not implement its permit-required confined space entry procedure prior to employees entering the Fluffer Baler through the bottom access door to unclog jams with a metal pole.  On March 20, 2015, one employee was engulfed and another employee had his hand stuck inside this confined space while attempting to unclog the Fluffer Baler.

29 CFR 1910.147(c)(4)(ii): Procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, 29 CFR 1910.147(c)(4)(ii)(A), (c)(4)(ii)(B), (c)(4)(ii)(C) and (c)(4)(ii)(D):  a)  Baler Area - Lockout procedures for the Fluffer Baler did not include the isolation of potential energy created by paper or books debris. Employees access the Fluffer Baler to conduct maintenance.  An employee's body part entered the Fluffer Baler through the bottom access door. The employee's hand was trapped in the baler when the potential energy from the jam was released.   Conditions occurred on or about March 20, 2015.

29 CFR 1910.147(d)(5)(i): All potentially hazardous stored or residual energy was not relieved, disconnected, restrained or otherwise rendered safe after the application of lockout or tagout devices to energy isolating devices:  a) Baler Area, 4581 Lower Valley Road, Atglen, PA 19310: The potential energy created by paper or books accumulating above the Fluffer Baler when it becomes jammed or clogged was not rendered safe for employees engaged in maintenance procedures for the Fluffer Baler. Employees occasionally open the lower door of the Fluffer Baler in order to unclog the equipment and the lockout procedure did not include a means to eliminate the hazard created by falling paper.  On March 20, 2015, one employee was engulfed and another employee had his hand injured when paper that was clogged in the Fluffer Baler released and dropped on the employees.
