29 CFR 1910.1000(a)(2): Employee(s) were exposed to an airborne concentration of carbon monoxide listed in Table Z-1 in excess of the 8-hour Time-Weighted Average concentration of 50 parts per million particles of air (ppm):    a)  In the Mall Retail Space - An employee, operating a Liquid-Propane (LP) powered floor stripper, was exposed to carbon monoxide (CO) at an 8-hour Time-Weighted Average (TWA) of 356 parts per million particles of air (ppm), approximately 7.12 times the Permissible Exposure Limit (PEL) of 50 ppm; this is the limit established to prevent CO poisoning.  The exposure level was derived from blood percent carboxyhemoglobin levels collected and analyzed at Reading Hospital and Medical Center, Pennsylvania after a 300-minute exposure period, during one work shift on February 8, 2015.      Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1910.1000(e): Feasible administrative or engineering controls were not determined and implemented to achieve compliance with the limits prescribed in 29 CFR 1910.1000(a) through (d), 8-hour Time-Weighted Average concentration of 50 parts per million particles of air (50 ppm) for carbon monoxide gas:  a)  In the Mall Retail Space - The employer did not implement feasible administrative and engineering controls to ensure that concentration levels of carbon monoxide (CO) gas did not exceed the 50 parts per million particles of air Permissible Exposure Limit (PEL) for an employee exposed to an 8-hour Time-Weighted Average (TWA) of 356 parts per million particles of air (ppm), approximately 7.12 times the PEL, during one 300-minute work shift on February 8, 2015.    Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. 29 CFR 1904.39(a)(2): The employer did not report an in-patient hospitalization, amputation, or loss of an eye as a result of a work-related incident to OSHA within twenty-four (24) hours:     a)  In the Mall Retail Space - An employee suffered a hospitalization on February 8, 2015, as a result of a carbon monoxide overexposure, resulting from the indoor use of a Liquid-Propane (LP) powered floor stripper.  The employer failed to report this work-related hospitalization to OSHA within 24 hours.  (The employer reported this hospitalization to OSHA on March 9, 2015.)    No abatement certification or documentation required.

29 CFR 1910.134(k)(6): The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer:  a)  In the Mall Retail Space - On or about February 8, 2015, an employee, operating a Liquid-Propane (LP) powered floor stripper, was voluntarily using a dust mask as respiratory protection against respirable dust (silica and PNOR, Particulates Not Otherwise Regulated) without being trained on the contents of 29 CFR Part 1910.134 Appendix D.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
