29 CFR 1910.1001(j)(1)(iii): Employer(s) did not include asbestos in the hazard communication program established to comply with the Hazard Communication Standard (HCS) 29 CFR 1910.1200, did not ensure that each employee had access to labels on containers of asbestos and to safety data sheets, and did not train employee(s) in accordance with the requirements of HCS and paragraph (j)(7) of this section.    a) Schuetzen Park, Inc. 3167 Kennedy Blvd. North Bergen, NJ    The employer did not include asbestos in the hazard communication program and ensure that each employee had access to labels, safety data sheets, and training in the hazards of asbestos, including but not limited to cancer and lung effects.  Employees conducting maintenance or custodial activities aree exposed to asbestos containing material (ACM) in thermal system insulation (TSI) found on pipes and spray on insulation found on the wall behind firing line containing 20% chrysotile asbestos and 15% chrysotile asbestos, respectively.     Condition observed on or about 3/16/2015.

29 CFR 1910.1001(j)(3)(i): Building and facility owner(s) did not determine the presence, location, and quantity of asbestos containing material (ACM) and/or presumed asbestos containing material (PACM) at the work site and did not exercise due diligence in complying with these requirements to inform employer(s) and employee(s) about the presence and location of ACM and PACM:    a) Schuetzen Park, Inc. 3167 Kennedy Blvd. North Bergen, NJ     The employer did not inform employees about the presence location and quantity of asbestos containing thermal system insulation (TSI) and spray-on insulation in the shooting range, exposing employees doing maintenance work to asbestos.  A bulk sample of TSI was found to contain 20% chrysotile asbestos and a bulk sample of the spray on insulation was found to contain 15% chrysotile asbestos.     Condition observed on or about 3/16/2015.

29 CFR 1910.1001(j)(5)(i): The employer did not affix signs or labels so that employees would be notified of what materials contain asbestos containing material (ACM) and/or presumed asbestos containing material (PACM) to materials that were previously identified to be ACM and/or PACM:    a)  Schuetzen Park, Inc. 3167 Kennedy Blvd. North Bergen, NJ    The employer did not label ACM and/or PACM with signs identifying that the material was present.  Employees conducting maintenance were exposed to asbestos containing material (ACM) in thermal system insulation (TSI) found on pipes and spray on insulation found on the wall behind firing line.   A bulk sample of TSI was found to contain 20% chrysotile asbestos and a bulk sample of the spray on insulation was found to contain 15% chrysotile asbestos.     Condition observed on or about 3/16/2015.

29 CFR 1910.1025(d)(2): An initial determination was not made to determine if any employee may be exposed to lead at or above the action level:    a) Schuetzen Park, Inc., 3167 Kennedy Blvd. North Bergen, NJ     The employer did not initially determine worker exposure to lead for the employee who cleans and maintains the shooting range.  Lead contamination was found within the facility to include: 571 micrograms (ug) on the surface of the water cooler,  49.1 ug on the men's bathroom sink and 96.0 ug on the table in the Lounge.  A bulk sample taken of the dirt down range contained 47.5% lead.    Conditions observed on or about 3/26/2015.
