29 CFR 1926.20(b)(2): The employer did not develop an accident prevention program, that provided for frequent and regular inspections of the job sites, materials, and equipment, to be made by competent persons designated by the employer.       a) 23 Winslow Dr., Jackson:  On or about April 2, 2015, the employer Apogee Builders LLC , had not initiated a program for a competent person to conduct frequent and regular inspections of the jobsite, to identify hazards and/or stop the work in the event workers were placed in a hazardous condition.  As such, framing employees were exposed to fall hazards of 10 - 18 feet, while conducting carpentry activities without proper use of fall protection.  Additionally, framers working under hoisted trusses were not wearing hard hats and were exposed to overhead struck-by hazards.           NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:   a) 23 Winslow Dr., Jackson, NJ:  On or about April 2, 2015, employees of Apogee Builders LLC were not wearing hard hats while working under hoisted trusses and were thus exposed to overhead struck-by hazards.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system.   a) 23 Winslow Dr., Jackson:  On or about April 2, 2015, framing workers / employees of Apogee Builders LLC, were exposed to fall hazards of 10 - 18 feet, while conducting carpentry activities, installing roof trusses, without use of fall protection.
