29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  An employee was working, on the leading edge of a residential construction building, at approximately 21 feet from ground level, handing 2"x4" lumber, used in framing, to other employees for completion of the construction operation.  The employer was operating the forklift  during this operation. The forklift was situated near the work site assisting in work.

29 CFR 1926.602(c)(1)(viii)(A): The industrial truck was not equipped with a safety platform/cage firmly secured to the lifting carriage and/or forks when used for lifting personnel:   At the residential construction zone, employees were elevated on a Briggs Equipment forklift, to access the work area approximately 29-30 feet above the ground level without a safety platform or cage firmly secured to the carriage or forks.

29 CFR 1926.1053(b)(13): The top or top step of a stepladder was used as a step:  At the residential construction zone employees were permitted to utilize the top step of an "A" frame ladder to access the work area approximately 8 feet above the next lower level.
