29 CFR 1910.212(a)(3)(ii): The point of operation of machines whose operation exposed an employee to injury, was not guarded: A.) Dean Dairy Holdings, LLC, dba Dean Dairy Products Company, 1858 Oneida Lane, Sharpsville, PA 16150, on or about March 23, 2015 and times prior thereto: On or about March 23, 2015, an employee suffered an amputation on a Cherry-Burrell EPOCH II packaging machine (M/N: Q-7, S/N: 4157), also referred to as the quart filling machine, when clearing a jam / retrieving a faulty cardboard carton in the machine. The machine contained moving parts including, but not limited to, a moving chain conveyer and an automatic suction paddle. The front of the machine contained a 10-13/16 inches wide by 14-5/8 inches deep opening that was not guarded. B.) Dean Dairy Holdings, LLC, dba Dean Dairy Products Company, 1858 Oneida Lane, Sharpsville, PA 16150, on or about April 23, 2015 and times prior thereto: The expandable metal guarding installed on the Cherry-Burrell EPOCH II packaging machine (M/N: Q-7, S/N: 4157), also referred to as the quart filling machine, following the amputation incident was not designed and constructed to prevent operators for placing hands and fingers in the danger zone of the point of operation. The expandable metal guard had openings of one-inch by one-inch. Additionally, the guard did not extend out to prevent contact with the automatic suction paddle.

Dean Dairy Holdings, LLC, dba Dean Dairy Products Company, 1858 Oneida Lane, Sharpsville, PA 16150, on or about March 23, 2015 and times prior thereto: On or about March 23, 2015, an employee suffered an amputation on a Cherry-Burrell EPOCH II packaging machine (M/N: Q-7, S/N: 4157), also referred to as the quart filling machine, when performing servicing and maintenance activities that included, but were not limited to, clearing a jam / retrieving a faulty cardboard carton, in the machine. The machine contained moving parts including, but not limited to, a moving chain conveyer and an automatic suction paddle. The machine was not locked out prior to accessing the danger area of the moving parts when performing the servicing and maintenance activities.

Dean Dairy Holdings, LLC, dba Dean Dairy Products Company, 1858 Oneida Lane, Sharpsville, PA 16150, on or about March 23, 2015 and times prior thereto: On or about March 23, 2015, an employee suffered an amputation on a Cherry-Burrell EPOCH II packaging machine (M/N: Q-7, S/N: 4157), also referred to as the quart filling machine, when clearing a jam / retrieving a faulty cardboard carton in the machine. The machine contained moving parts including, but not limited to, a moving chain conveyer and an automatic suction paddle. The employee was performing service and maintenance type activities when clearing the jam / retrieve the faulty cardboard carton in the machine. The employee was trained as an affected employee, but had not received training as an authorized employee for lockout / tagout.
