29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraphs (b) or (c) of this section:  (a)Underhill Excavating, Inc. @ 526 Pine Street, Glenwood Springs, CO:  On and before March 19th, 2015, as part of the injury/accident prevention responsibilities, the exposing employer did not ensure that each employee conducting work in the trench was protected from a possible cave-in. The excavation at the east side end, measured approximately between 9 and 11 feet depth and 45 feet long. The excavation lacked a protective system, such as appropriate sloping, benching, or shield systems. The conditions exposed the employees to a potential crushing hazard by trench wall cave-in.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions:  (a)Underhill Excavating, Inc., @ 526 Pine Street., Glenwood Springs, CO:  On and before March 19th, 2015, as part of the injury/accident prevention responsibilities under its safety program, the exposing employer did not ensure that a competent person conducted an inspection(s) of the excavation, the adjacent areas, and protective systems for evidence of a situation that could have resulted in possible excavation cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions before allowing employees to work in the excavation to conduct pipe connections activities. The excavation at the east end, measured approximately between  9 and 11 feet in depth and 45 feet long lacked any protective system, such as appropriate sloping, benching, or shield systems. The condition exposed the employees to a potential crushing hazard by trench wall cave-in.      Abatement note: The requirements and duties of a competent person are:    (1)        A competent person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them.    (2)        The competent person must understand and be able to carry out the tasks specified in the OSHA standard.  The competent person must have knowledge about the protective systems and the safety program.
