29 CFR 1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached) where the outside bottom edge of the wall opening is 6 feet or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches above the walking/working surface, was not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system.  a) For the Lakewood Ranch construction site at 9850 Town Center Parkway, Bradenton, FL 34202, employees were exposed to fall hazards from an unguarded, 18 inch wide wall opening above an open kitchen ventilation shaft. On 04/03/2015, an employee fell 31 ft and 11.25 inches through the kitchen shaft to the concrete surface below sustaining fatal injuries.

29 CFR 1926.502(d)(15)(ii): Anchorages used for attachment of personal fall arrest equipment were not installed under the supervision of a qualified person.    a) For the Lakewood Ranch construction site at 9850 Town Center Parkway, Bradenton, FL 34202, the installation of anchor points was not supervised by a qualified person.  Employees who installed anchor points were not aware of the necessary load capacity of the anchor point for fall arrest, on or about 04/07/2015.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:    a) For the Lakewood Ranch construction site at 9850 Town Center Parkway, Bradenton, FL 34202, employees worked on roofs over 4 stories high and were not aware of the height requirement that necessitated fall protection, were not aware of how many pounds an anchor point could hold, and were unsure of when it was required to wear fall protection.
