Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to struck-by hazards while using a portable crane: (a) Waste water treatment plant, employees were exposed to struck by hazard while using a portable wheeled crane that was improperly set up to lift a waste water pump. The portable cranes boom was set in the third outer position and the legs were set at the first inner position which is a "do not use" configuration according to the owner's manual for operations.
