OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by, crushed-by and caught-between hazards from defective safety related equipment on a tractor trailer. a) Jobsite, 2824 William Penn Avenue, Johnstown, PA 15909: On or about April 08, 2015, a tractor trailer (2003 Western Star, VIN #2WKJAHAV63KK32245) was not equipped with a functional back-up alarm. This condition exposed employees working in the vicinity of the tractor trailer to struck-by, crushed-by, and caught-between hazards while the tractor trailer was used at the main office and at offsite locations.
