OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by, crushed-by and caught-between hazards from defective safety related equipment on a tractor trailer.  a)  Jobsite, 2824 William Penn Avenue, Johnstown, PA 15909:  On or about April 08, 2015, a tractor trailer (2003 Western Star, VIN #2WKJAHAV63KK32245) was not equipped with a functional back-up alarm.  This condition exposed employees working in the vicinity of the tractor trailer to struck-by, crushed-by, and caught-between hazards while the tractor trailer was used at the main office and at offsite locations.

The distance between the oxygen cylinders and an acetylene cylinder was less than approximately 1 foot.  Employees working in the shop area were exposed to a fire hazard.

29 CFR 1910.303(g)(1)(ii):  Working space about electric equipment rated 600 volts, nominal, or less was used for storage:                                                                  a) Main Shop Area, near employee break area table, 2824 William Penn Avenue, Johnstown, PA 15909:  Observed on or about April 9, 2015, the working space in front of electrical panels which housed the main disconnect for the building, was used storage.  A table, bucket, and other materials were stored in front of the electrical panels.  Employees working in the main shop were exposed to fire and electric shock hazards created by restricted access to electrical panels.
