OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards while working from a 19 foot long platform elevated by a telehandler. (a) On or about April 8, 2015 for an employee exposed to fall hazards while working on an elevated work platform, up to 10 feet high, attached to the forks of a Gradall 534D9-45 Telehandler at 5585 Edward Court in Grand Forks, North Dakota. Abatement Note: Among other means, feasible and acceptable methods to correct the hazard would be to follow ASME B56.6b - 1992 Safety Standard for Rough Terrain Forklift Trucks including but not limited to: 1. Use a platform that does not extend more than two times the load center distance listed on the rough terrain forklift truck nameplate, measured parallel to the longitudinal center plane of the truck. 2. Use an alternative means to elevate employees to working levels.
