29 CFR 1926.25(a): During the course of construction, alteration, or repairs, form and scrap lumber with protruding nails, and all other debris, shall be kept cleared from work areas, passageways, and stairs, in and around buildings or other structures. On or about April 9 2015, at this residential construction, the working surroundings had scrap material and debris scattered throughout the construction site creating tripping hazards.

29 CFR 1926.300(b)(2): Belts, gears, shafts, pulleys, sprockets, spindles, drums, fly wheels, chains, or other reciprocating, rotating or moving parts of equipment shall be guarded if such parts are exposed to contact by employees or otherwise create a hazard. Guarding shall meet the requirements as set forth in American National Standards Institute, B15.1-1953 (R1958), Safety Code for Mechanical Power-Transmission Apparatus. On April 9, 2015, and times prior there to, at this jobsite, employees used a 230v Englo Products Corporation air compressor without a guard, to energize a pneumatic nail gun.
