29 CFR 1910.178(l)(4)(ii)(B): Refresher training, including an evaluation of the effectiveness of that training, was not provided to the operator when the operator has been involved in an accident or near-miss incident: A) First Choice Packaging Solutions, Inc., located at 1501 West State Street, Fremont, OH 43420: On or about March 25, 2015, the employer failed to provide refresher training in safe operation of a powered industrial vehicle for the employee who was involved in incidents/near misses while driving forklifts such as, but not limited to, the Caterpillar 35 (Model GC18, Serial # 2EM05974) in the facility. The operator lost a load (a skid of empty cartoons) and struck the equipment causing damage while operating the forklift in the facility. Employees were exposed to struck-by hazards due to the lack of re-training. First Choice Packaging Solutions, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1910.178(l)(4)(iii)), which was contained in OSHA Inspection # 313787103, Citation number 1, Item number 3B, and was affirmed as a final order on 07/07/2011, with respect to a workplace located at 1501 West State Street, Fremont, OH 43420.

29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s): A) First Choice Packaging Solutions, Inc., located at 1501 West State Street, Fremont, OH 43420: On or about April 8, 2015, the employer did not remove the Caterpillar forklift (Model GC25, Serial # AT82C00091) from use based on mechanical defect such as, but not limited to, defective parking brake. Employees were exposed to struck-by and caught-in-between hazards. B) First Choice Packaging Solutions, Inc., located at 1501 West State Street, Fremont, OH 43420: On or about April 8, 2015, the employer did not remove the Caterpillar 35 forklift (Model GC18, Serial # 2EM05974) from use based on mechanical defect such as, but not limited to, defective steering. Employees were exposed to struck-by and caught-in-between hazards.
