Christopher Miller dba CM Miller Masonry, 5050 West Ridge Road, Erie, PA  16506, south side of the structure, ground level, on or about April 10, 2015 and times prior thereto:  An employee was hoisting scaffolding components including, but not limited to, planking, to an employee 20.3 feet overhead for scaffold erection operations via a rope and pulley system.  The employee hoisting the scaffolding components directly below was not wearing head protection.

29 CFR 1926.451(e)(9): Access for employees erecting or dismantling supported scaffolds were not in accordance with 29 CFR 1926.451(e)(9)(i) - (e)(9)(iv):  A.)  Christopher Miller dba CM Miller Masonry, 5050 West Ridge Road, Erie, PA  16506, south side of the structure, on or about April 10, 2015 and times prior thereto:  An employee was erecting a scaffold at a height of 20.3 feet.  The employee was accessing the scaffolding via the end frames.  The scaffold end frames were not suitable for access / egress in that the height and width of the access steps were not uniform.  A suitable ladder was not positioned and/or used for accessing/egressing the scaffold.   B.)  Christopher Miller dba CM Miller Masonry, 5050 West Ridge Road, Erie, PA  16506, south side of the structure, on or about April 10, 2015 and times prior thereto:  An employee was erecting a scaffold at a height of 20.3 feet.  The employee was accessing the scaffolding via the end frames, and supplemented access and egress by stepping onto the installed cross bracing of the erected portion of the scaffold. A suitable ladder was not positioned and/or used for accessing/egressing the scaffold.

29 CFR 1926.451(c)(2): Supported scaffold poles, legs, posts, frames, and uprights did not bear on base plates and mud sills or other adequate firm foundation:  A.)  Christopher Miller dba CM Miller Masonry, 5050 West Ridge Road, Erie, PA  16506, south side of the structure, on or about April 10, 2015 and times prior thereto:  An employee was erecting a scaffold at a height of 20.3 feet.  The scaffold pole base plates were not squarely placed on the mud sills in that they were overhanging the edge of the mudsill.  In addtion, the scaffold base plates and were not secured to the mud sills to prevent displacement.

Christopher Miller dba CM Miller Masonry, 5050 West Ridge Road, Erie, PA  16506, east side of the structure, on or about April 10, 2015 and times prior thereto:  An employee was performing masonry operations including, but not limited to, grouting blocks.  The employee was performing these operations while sitting in a window opening 12-feet above ground level.  The employee was not provided with means and methods of fall protection including, but not limited to, an adequate guardrail system, a safety net system, or a personal fall arrest system.

29 CFR 1926.150(a)(1): The employer did not develop and maintain a fire protection program to be followed throughout all phases of construction and demolition work, and/or did not provide for the firefighting equiment as specified in this subpart:  A.)  Christopher Miller dba CM Miller Masonry, 5050 West Ridge Road, Erie, PA  16506, on or about April 10, 2015 and times prior thereto:  Dry chemical fire extinguisher that were deployed on-site had last received annual maintenance in October 2013.  The fire extinguishers were owned by the building owner.  The company relied on these fire extinguisher for fire protection, and employees were permitted to use these fire extinguishers.  The company had not deployed their own fire extinguishers in the building.    B.)  Christopher Miller dba CM Miller Masonry, 5050 West Ridge Road, Erie, PA  16506, on or about April 10, 2015 and times prior thereto:  Dry chemical fire extinguishers were deployed on-site for employee use.  Employees had not received training on the use of portable fire extinguisher equipment.
