29 CFR 1926.451(f)(3): Scaffolds and scaffold components were not inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity:  a)  At Lot 40 East Lake, Auburn, Alabama:  On or about April 8, 2015 and at times prior; the employer failed to inspect scaffolding prior to use and allowed the co-owner to tie off to an anchor point which was not installed as per the manufactures recommendations exposing the employee to a fall hazard of in excess of 25 feet to the concrete floor below.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:  a)  At Lot 40 East Lake, Auburn, Alabama:  On or about April 8, 2015 and at times prior; the co-owner of the company was observed walking on the scaffold and did not have fall protection exposing himself to a fall hazard in excess of 25 feet to the concrete floor below.

29 CFR 1926.451(g)(1)(iii): Each employee on a crawling board (chicken ladder) shall be protected by a personal fall arrest system, a guardrail system (with minimum 200 pound toprail capacity), or by a three-fourth inch (1.9 cm) diameter grabline or equivalent handhold securely fastened beside each crawling board:  a)  At Lot 40 East Lake, Auburn, Alabama:  On or about April 8, 2015 and at times prior; the co-employer was observed standing on a chicken board leading to scaffolding and he did not have fall protection exposing himself to a fall hazard of in excess of 25 feet to the concrete floor below.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a)  At Lot 40 East Lake, Auburn, Alabama:  On or about April 8, 2015 and at times prior; the employer allowed his employees to walk the top of framed walls without fall protection exposing them to a fall hazard of 10.7 feet to the concrete floor below.  b)  At Lot 40 East Lake, Auburn, Alabama:  On or about April 8, 2015 and at times prior; the employer allowed his employees to walk the second floor top near the edge without fall protection exposing them to a fall hazard of 11.4 feet to the concrete floor below.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) At Lot 40 East Lake, Auburn, Alabama:  On or about November 8, 2015 and at times prior;  the employer failed to ensure an extension ladder used to gain access to the area above the garage and the rails of the ladder did not extend three feet above the landing area exposing the employee to a fall hazard of 11.4 feet to the concrete floor below.
