29 CFR 1926.451(g)(1)(iii): Each employee on a crawling board (chicken ladder) was not protected by a personal fall arrest system, a guardrail system (with minimum 200 pound toprail capacity), or by a three-fourth inch (1.9 cm) diameter grabline or equivalent handhold securely fastened beside each crawling board. On or about April 13, 2015 and at times prior thereto, an employee used an extension ladder as a crawling board(chicken ladder) to replace a terracotta roof on a 3 story residential home, approximately 24 feet above the ground without fall protection.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b). On or about April 13, 2015 and at times prior thereto at the residential construction site, employees engaged in replacing a terracotta roof on a three story home, approximately 24 feet to the ground, without fall protection. C.K. McConkey & Sons was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1296.501(b)(13), which was contained in OSHA inspection number 316302538, citation number 2, item number 2 and was affirmed as a final order on June 4, 2012, with respect to a workplace located at 1701 Foxhall Rd. NW, Washington DC, 20016.
