29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s):   (a) On or about April 7th, 2015, at a construction site located at 201 Westport Road in Kansas City, MO, a worker entered a confined space and became functionally impaired by toxic vapors emitted from an adhesive sealant that he was applying.  The confined space (a concrete vault) was not marked as being a confined space, a deficiency that should have been identified and corrected by frequent and regular job site inspections.   Abatement certification is required for this Item.  Use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.  NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.21(b)(5): Employee(s) required to handle or use flammable liquids, gases, or toxic materials were not instructed in the safe handling and use of these materials and made aware of the specific requirements contained in 29 CFR 1926, subparts D:   (a) On or about April 7th, 2015, at a construction site located at 201 Westport Road in Kansas City, MO, and under the control of A. L. Huber, Inc., a worker entered a confined space (concrete vault) and began applying a toxic and flammable adhesive sealant to its interior concrete walls.  The worker became functionally impaired by the toxic vapors and required assistance from the Kansas City Fire Department to extricate himself from the confined space.  The worker had not been adequately trained in the handling of hazardous (toxic) materials in that he entered a confined space with a 5 gallon bucket of adhesive sealant boldly marked "Warning Under Poorly Ventilated Conditions, Confined Space Safety Procedures Must Be Followed or Serious Injury or Death May Result".   Abatement certification is required for this Item.  Use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.  NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.21(b)(6)(i): Employees required to enter into confined or enclosed spaces were not instructed as to the nature of the hazards involved, the necessary precautions to be taken, and in the use of protective and emergency equipment required:   (a) On or about April 7th, 2015, at a construction site located at 201 Westport Road in Kansas City, MO, and under the control of A. L. Huber, Inc., a worker entered a confined space and began applying a toxic adhesive sealant to its interior walls.  The worker became sufficiently disoriented from the toxic vapors that he required assistance from the Kansas City Fire Department to extricate himself from the confined space.  The worker had not been properly instructed on the nature of the hazard involved, the necessary precautions to take, and in the use of personal protective equipment (i.e., a respirator).   Abatement certification is required for this Item.  Use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose.  NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
