29 CFR 1926.501(b)(15): Each employee on a walking/working surface 6 feet (1.8 meters) or more above lower levels was not protected from falling by a guardrail system, safety net system, or personal fall arrest system: a) Borgata Hotel, Event Center: Employees assembling and dismantling the Stage Right staging platform were not protected from falling. On 4/12/15 an employee dismantling the platform fell approximately 12 feet to the floor below and died. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: a) Borgata Hotel, Event Center: A training program was not provided to each employee who was exposed to a fall hazard while assembling or dismantling the Stage Right staging platform. On 4/12/15 an employee dismantling the platform fell approximately 12 feet to the floor below and died.
