OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to fall hazards, crushing injuries and amputation hazards during periodic cleaning/sanitation of plant equipment: a) Plant - On or about 04/08/15 and at times prior thereto employees conducted periodic cleaning/sanitation of the CBD 700 Breader, which required reaching elevated parts of the machine for disassembly and inspection. The machine was kept under movement during states of cleaning, with the auger guards open. Employees were at risk of slipping, falling, and coming in contact with moving parts of the equipment. 1. The employer did not implement and enforce a policy for the systematic use of fall protection equipment, and did not provide portable ladders, stairs, fixed ladders, fall protective equipment and/or any arrangement of tools and equipment to prevent the slip and fall of employees who needed to reach the upper part of machinery during the sanitation work. 2) The employer did not protect workers by placing alternative guards on top of the augers, or by guarding by distance by installation of a barrier to control the proximity to the moving parts, or by resorting to any other protective measure. 3) The employer did not train the workers in the recognition of the unique hazards inherent to the sanitation of the CBD 700 Breader, including (but not limited) to the slip/fall hazards and amputation hazards. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.219(f)(3): Sprocket wheels and chains which were seven -7 feet or less above floors or platforms were not enclosed: a) Plant - On or about 04/08/15 and at times prior thereto employees operated and conducted sanitation operations on the CBD 700 Breader Machine. The chain and sprocket system connected to the electric motor/gear box in the lower right side of the equipment was not guarded, exposing workers to amputations. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.303(f)(1): Each disconnecting means required by Subpart S of Part 1910 for motors and appliances was not legibly marked to indicate its purpose, nor located and arranged so the purpose was evident: a) Plant - On or about 04/08/15 workers conducted sanitation operations on the CBD 700 Breader, and selectively connected/disconnected power to the different areas of the machine requiring movement during sanitation. Labels identifying the twelve buttons in the panel were degraded and were not legible, leading to errors and exposing workers to crush/amputations hazards. Or in the alternative: 29 CFR 1910.303(f)(3): The markings required by paragraphs (f)(1) and (f)(2) of 29 CFR 1910.303 were not sufficiently durable to withstand the environment involved: a) Plant - On or about 04/08/15 workers conducted sanitation operations on the CBD 700 Breader, and selectively connected/disconnected power to the different areas of the machine requiring movement during sanitation. Labels identifying the twelve buttons in the panel were degraded and were not legible, leading to errors and exposing workers to crush/amputations hazards.
