A. Washam Plumbing, Heating & Air, Inc. worksite located at 3209 Makley, Lima, Ohio: On or about April 13, 2015, the employer failed to instruct all employees in the recognition and avoidance of hazards commonly seen in the excavation industry. Employees were installing a sanitary sewer line in an unprotected trench and were not effectively trained to recognize ineffective means of cave-in protection.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection shall be conducted by the competent person prior to the start of work and as needed throughout the shift. Inspections shall also be made after every rainstorm or other hazard increasing occurrence. These inspections are only required when employee exposure can be reasonably anticipated. A. Washam Plumbing, Heating & Air, Inc. worksite located at 3209 Makley, Lima, Ohio: On or about April 13, 2015, the employer did not ensure the trench in which employees were working was inspected by a competent person at the beginning of each workday and throughout the shift. The need for adequate and effective cave-in protection and method of egress while employees were working in the trench was not recognized.
