At the site, on or about 04/15/2015 ,employees installing gutters from a scaffold were exposed to a 14 foot fall hazard, in that, the scaffold was supported by a rock, a piece of wood, and broken tiles.

29 CFR 1926.451(e)(1): A means of access for scaffold platforms more than 2 feet (0.6 m) above or below a point of access, such as portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface was not used.   a. At the site, on or about 04/15/2015, employees were exposed to a 14 foot fall hazard, in that, scaffold members were used for access and egress.

29 CFR 1926.454(b): The employer did not have each employee involved in erecting, disassembling, moving, operating, repairing, maintaining, or inspecting a scaffold trained by a competent person to recognize any hazards associated with the work in question.  a. At the site, on or about 04/15/2015, employees were exposed to a fall hazard of up to 14 feet, in that the employee(s) who erected the scaffold were not trained to recognize hazards associated with the work as evidenced by the fact that: the scaffold was not fully planked; the uprights were bearing on a rock, a piece of wood and broken tiles; and, a safe means of access was not provided.
