29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface were not used. (a) Employees working on a scaffold located on the east end of a building being constructed were not provided proper access/egress to the first, second and third tiers which were all more than two feet above the ground where the scaffolding was being accessed from. Employees improperly utilized the end frames of scaffolds which exposed them to a fall hazard of up to approximately 18' 8".

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold: (a) An employee was exposed to a fall hazard while working on the third tier at a height of approximately 18' 8" on a scaffold with no side railings installed, nor a top rail. The scaffolding had been erected for masonry work being done to the east end of a building being constructed. An employee was exposed to a fall hazard of over 10' while working from the second tier on a scaffold with no mid-railing or side railing installed.
