29 CFR 1910.178(L)(1)(ii):  The employer did not ensure that each operator of a powered industrial truck had successfully completed the training required by paragraph (L).   (a)Luna Framing and Construction at 13684 107th Avenue, Commerce City, CO:  On and before April 15th, 2015, the employer did not ensure employees operating a rough terrain forklift (Xtreme XRM842) for the purpose of lifting framed walls and steel I-beams had successfully completed the required training in paragraph L. The condition exposed employees to unsafe operations involving the rough terrain forklift.  Abatement Note:  The requirements applicable to construction work under paragraph 29 CFR 1926.602(d), are identical to those set forth in 1910.178(l).   Abatement Note: Per paragraph 29 CFR 1926.178(L)(6), the shall certify that each operator has been trained and evaluated as required by paragraph (L). The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluations. Abatement Note:  Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1926.251(e)(8): Synthetic web slings were not immediately removed from service if any of the following conditions specified in 1926.251(e)(8)(i) through (e)(8)(v) were present:  (i) Acid or caustic burns; (ii) Melting or charring of any part of the sling surface; (iii) snags, punctures, tears, or cuts; (iv) broken or worn stitches; or (v) distortion of fittings.   (a)Luna Framing and Construction at 13684 107th Avenue, Commerce City, CO:  On and before April 15th, 2015, the employer did not ensure an excessively worn synthetic web sling attached to the tines of a rough terrain forklift (Xtreme XRM842), to lift and place a steel I-beam on top of a wood framed wall over the garage area was removed from service. The condition exposed employees to struck-by hazards.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   (a)Luna Framing and Construction at 13684 107th Avenue, Commerce City, CO: On and before April 15th, 2015, the employer did not ensure employees were protected from fall hazards of approximately 8 feet while standing on the top plates on wood framed walls. The employer had not ensured the use of appropriate fall protection or an alternative fall protection plan. The condition exposed employees to fall hazards of approximately 8 feet.

29 CFR 1926.1053(b)(13): The top or step of a stepladder was used as a step:   (a)Luna Framing and Construction at 13684 107th Avenue, Commerce City, CO: On or about April 15th, 2015, the employer did not provide ladders with sufficient height for framing activities. As a result, an employee was observed standing on the top step of a 6 foot fiberglass Werner ladder to frame the top of walls.  The condition exposed an employee to a fall hazard of approximately 6 feet off of the ladder.

29 CFR 1926.1060(a)(1)(iii): The employer did not ensure that each employee using ladders and/or stairways had been trained by a competent person in the proper construction, use, placement, and care in handling the ladders and/or stairways:   (a)Luna Framing and Construction at 13684 107th Avenue, Commerce City, CO: On and before April 15th, 2015, the employer had not ensured employees were appropriately trained by a "competent person" to recognize the hazards associated with ladder use. An employee was observed standing on the top step of a 6 foot fiberglass Werner ladder to work on the top section of a framed wall. The condition exposed employees to a fall hazard of approximately 6 feet.
