29 CFR 1926.760(a)(1): Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems.  The employer does not ensure that employees engaged in a steel erection activity with an unprotected side or edge more than 15 feet above a lower level are protected from falling by a fall protection system.  This violation was observed on or about April 16, 2015 at the Shell Gas Station construction site where an employee was exposed to a fall hazard while working more than 15 feet off of the ground near the unprotected sides of the canopy roof.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees engaged in steel erection activities and working 15 feet or more above a lower level are protected from falling by a fall protection system.

29 CFR 1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed.  The employer does not ensure that ladders are used for purposes for which they were designed.  This violation was observed on or about April 16, 2015 at the Shell Gas Station construction site where an employee climbed up and onto a canopy roof using a stepladder that was in the closed position.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that ladders are used for purposes for which they were designed.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level was not protected from falling to that lower level.  The employer does not ensure that employees working on a scaffold more than 10 feet above a lower level was protected from falling to the lower level by the use of a fall protection system.  This violation was observed on or about April 16, 2015 at the Shell Gas Station construction site where an employee was exposed to a fall hazard from a hydraulic lift scaffold platform more than 10 feet off of the ground.  Frank Kollmann dba KS Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 C.F.R. 1926.451(g)(1), which was contained in OSHA inspection number 314182205, citation number 1, item number 1 and was affirmed as a final order on 4/27/2012, with respect to a workplace located at 145 West Ann Arbor Avenue Dallas, TX 75224.  Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees working 10 feet or more above a lower level are protected from falling by a fall protection system.
