29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, and protective clothing, was not used by reason of hazards of processes or environment, encountered in a manner capable of causing injury or impairment in the function of any part of the body through physical contact.    (a)  1042 Manor Lane, Bay Shore, NY (Worksite) - Employees engaged in energized electrical work, involving voltages of up to 240 volts AC, and were not using personal protective equipment (PPE) such as, but not limited to eye and face protection, electrical rated gloves, and flame resistant clothing to protect themselves in the event they came into contact with energized electrical circuits on, or about April 15, 2015.      Note: In addition to abatement certification, the employer is required to submit abatement documentation for this violation, in accordance with 29 CFR 1903.19.

29 CFR 1926.416(a)(1): Employees were permitted to work in proximity to electric power circuits and were not protected against electric shock by de-energizing and grounding the circuits or effectively guarding the circuits by insulation or other means:    (a) Worksite, garage and south exterior wall - Employees removed the dead front cover from the 100 amp / 240 volt main service panel, without de-energizing and grounding the circuit, insulating, or other means. The employees ran electrical wiring and installed breakers in the main service panel and worked within inches of the energized circuits on, or about April 15, 2015.       Note: In addition to abatement certification, the employer is required to submit abatement documentation for this violation, in accordance with 29 CFR 1903.19.

29 CFR 1926.416(a)(3): Before work began, the employer did not ascertain by inquiry, direct observation, or by instruments, whether any part of an energized electric power circuit, exposed or concealed, was so located that the performance of the work could bring any person, tool, or machine into pysical or electrical contact with the electric power circuit.    (a) Worksite - Prior to the start of work, the employer failed to determine if the electrical utility service drop, extending between the utility pole and residential home, was energized by inquiring with the utility owner, direct observation, or instruments on, or about April 15, 2015.       Note: In addition to abatement certification, the employer is required to submit abatement documentation for this violation, in accordance with 29 CFR 1903.19.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     (a) Worksite, Roof - Employees installed solar panels and associated hardware on a low slop roof, 4:12, without any form of fall protection. The employees were exposed to falls ranging between 10' and 16'-4" to the ground below while they worked directly along the edges of the eaves and ridge, respectively, on, or about April 15, 2015.       Note: Abatement for this violation was previously documented; therefore, the employer is not required to submit abatement certification or documentation for this violation in accordance with 29 CFR 1903.19.
