29 CFR 1926.752(a)(1): Before authorizing the commencement of steel erection, the controlling contractor did not ensure that the steel erector was provided with written notification that the concrete in the footings, piers and walls and the mortar in the masonry piers and walls had attained, on the basis of an appropriate ASTM standard test method of field-cured samples, either 75 percent of the intended minimum compressive design strength or sufficient strength to support the loads imposed during steel erection.    (a) 260 Ocean Road, Bridgehampton, NY (Worksite) - The general contractor authorized the steel erection sub-contractor to commence steel erection activities, including, but not limited to the installation of structural steel posts, ranging in sizes of 5 x 5 x 10-2 L and 3-1/2 x 3-1/2 x 10-2 L, and W12 x 96 structural steel beams, approximately 20 L, without ensuring that the concrete foundation had attained, either 75 percent of the intended minimum compressive design strength or sufficient strength to support the loads imposed by the structural erection on, or about April 15, 2015.      Note: In addition to abatement certification, the employer is required to submit abatement documentation for this violation, in accordance with 29 CFR 1903.19.

29 CFR 1926.1402(c)(1): 29 CFR 1926.1402(c)(1): The controlling contractor did not inform the user of the equipment and the operator of the location of hazards beneath the equipment set-up area (such as voids, tanks, utilities) when those hazards were identified in documents (such as site drawings, as-built drawings, and soil analyses) that were in the possession of the controlling entity (whether at the site or off-site) or the hazards were otherwise known to that controlling contractor.    (a) Worksite - The National Crane, Model # 900A / Serial # 290557, was erected and operated on ground that was previously disturbed. The controlling contractor had prior knowledge that the previous homes foundation was located where the crane was erected and that the ground in that area had recently been backfilled. The controlling contractor did not inform the user and operator of the crane that the ground was previously disturbed on, or about April 15, 2015.      Note: The employer is required to submit abatement documentation for this violation, in accordance with 29 CFR 1903.19.
