29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace. On or about April 24, 2015, the employer failed to ensure that employees operating fork trucks completed training consisting of a combination of formal instruction and practical training in that the employer failed to provide an employee with formal instruction prior to the employee operating a fork truck.

On or about April 24, 2015, the employer failed to ensure that employees do not pass under the elevated portion of the powered industrial truck in that an employee working in department 321 drove a fork truck under the lifted load of another fork truck in an effort to get around the blocked aisle way.

On or about February 27, 2015, the employer did not ensure that the fork truck operator involved in an incident received retraining. The operator was involved in an incident in department 323 while unloading high stacks from a truck when they pulled forward hitting an empty pallet pushing damaging a bay door.
