29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:   a.      On April 16, 2015, at the production area, a down cutter operator cutting and bagging foam, was exposed to a noise dose of 84.63%, or an equivalent dBA (decibels A scale) of 88.7 dBA, which is capable of causing permanent hearing loss. The noise sampling was conducted for 418 minutes during one work shift.   The employer did not administer an effective hearing conservation program in that employees were not provided the required initial monitoring program, baseline or annual audiograms, and hearing protection training that included an explanation of audiometric testing, instructions on the fitting, use, and care of the various hearing protectors.

29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible:  a.      On or about April 16, 2015, employer allowed employees to use dust masks on a voluntary basis while working in the production area and the employer had not provided those employees with the information contained in Appendix D of 29 CFR 1910.134 respiratory protection.    Imperial Foam & Industrial Manufacturing Co, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.134(c)(2)(i), which was contained in OSHA inspection number 315483230, citation number 2, item number 3 and was affirmed as a final order on May 21, 2012, with respect to a workplace located at 2360 Old Tomoka Rd., Ormond Beach, Florida, 32174.

On or about April 16, 2015, employees used hazardous chemicals such as, but not limited to polymeric beads, Clayton industries comd-1, and lubricants while working in the production area. The employer did not develop nor implement at the workplace a written hazard communication program.

On or about April 16, 2015, employees used hazardous chemicals such as, but not limited to polymeric beads, Clayton industries comd-1, and lubricants while working in the production area. The employer did not provide the information and training on the new label elements and the new safety data sheet format to those employees.
