OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of delayed rescue from a permit-required confined space with the potential for oxygen deficient atmospheres and/or hazardous levels of toxic and flammable vapors and/or limited sight conditions that could impair self-rescue:   On or about March 25, 2015 and at times prior thereto, employee(s) entered the ball of a water tower to conduct sandblasting and painting operations, and stand-by person(s) were not provided with a mechanical means for vertical retrieval of personnel from the space, which was approximately 36 feet deep.

29 CFR 1926.21(b)(6)(i): Employees required to enter into confined or enclosed spaces were not instructed as to the nature of the hazards involved, the necessary precautions to be taken, and in the use of protective and emergency equipment required:  At the inspection site, on or about 4/16/2015 and at times prior thereto, employees who were engaged in sandblasting and coating operations in the ball of a water tower were not adequately trained to recognize a permit-required confined space and the necessary precautions to be taken, such as monitoring needed to determine if acceptable entry conditions are being maintained throughout the entry, and the use of emergency equipment required by the employer, including mechanical device(s) for retrieval of personnel from vertical-type permit spaces more than five feet deep.

29 CFR 1926.51(f)(1): The employer did not provide adequate washing facilities for employees engaged in the application of paints, coating, herbicides, or insecticides, or in other operations where contaminants may be harmful to the employees:   At the inspection site located at 107 Charolais Drive near Bastrop, Texas, on or about April 16, 2015 and at times prior thereto, washing facilities were not provided for employees who were using Tnemec coatings with skin absorption and skin contact hazards, exposing employees to the hazards of chemical contact such as chemical burns.

29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:   And/or in the alternative:  29 CFR 1926.102(a)(5): Table E-1 Eye and Face Protector Selection Guide was not used as a guide in the selection of face and eye protection for the hazards and operations noted:  At the inspection site located at 107 Charolais Drive near Bastrop, Texas, on or about April 16, 2015 and at times prior thereto, employees who were handling Tnemec coatings that presented burn hazards to eyes and face were wearing safety glasses with sideshields in lieu of chemical-protective equipment, exposing employees to chemical contact hazards such as chemical burns.      Abatement Note: From Table E-1, recommended protectors for splash, acid burns and fumes from chemical handling are Goggles, Flexible Fitting - Hooded Ventilation (#2) or Face Shield (#10).

29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form:  At the inspection site located at 107 Charolais Drive near Bastrop, Texas, on or about April 16, 2015 and at times prior thereto, airborne exposures to hexamethylene diisocyanate (HDI) were not evaluated for employees who were using Tnemec coatings such as Series 1074 Part B Endura-Shield II Converter, exposing employees to chemical inhalation hazards such as respiratory irritation, headache, dizziness and nausea.
