OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or are likely to cause death or serious physical harm to his employees, in that employees were exposed to health hazards associated with accumulations of lead that employees may have skin contact with: Accumulations of lead were found at the following areas on May 14, 2015: (a) In the machine shop, wipe samples taken of the railing next to Buffoli Machine #1 showed 1707.0000 micrograms of lead; (b) In the machine shop, wipe samples taken of the work bench by Buffoli Machine #4 showed 2980.7000 micrograms of lead; Among other methods, one feasible and acceptable method to correct this hazard is for the employer to develop and implement a rigorous housekeeping program to keep the accumulation of lead to a minimum. Cleaning methods can include but are not limited to vacuuming with appropriate HEPA vacuums and/or cleaning with an appropriate lead cleaner.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: (a) Employees using degreaser product 5440 were not provided with information or training on the hazards of that chemical, exposing employees to chemical hazard. (b) Employees in the machine shop who work with and/or in proximity to and/or around 360 brass containing lead were not provided training in accordance with the requirements of the hazard communication standard, 29 CFR 1910.1200.
