29 CFR 1910.242(a): The employer did not ensure that employees were furnished with tools and equipment that were in a safe condition: (a) Industrial Battery Plant, Battery Repair Area - To remove battery cells from industrial battery trays, employees used a cell puller, a homemade device, which consisted of a round lug welded onto a C-shaped metal angle. The round lug fit onto the hook of a hoist while the C-shaped angle fit through connectors on the tops of the battery cells. While hoisting, moving, and lowering battery cells, employees held the cell puller to keep this device from slipping out from the connector because the cell puller did not adequately grip the connector, exposing employees to caught-in or pinched-in hazards, as happened on April 17, 2015 when an employee holding the cell puller in place suffered an amputation of the tip of the right ring finger, which got pinched between hoisted battery cells and the battery tray. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and shall state that employees and their representatives were informed of this abatement.

29 CFR 1904.39(a)(2): Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, the employer did not report the in-patient hospitalization, amputation, or loss of an eye to OSHA: (a) East Penn Manufacturing Company, Inc., 102 Deka Road, Lyon Station, Pennsylvania - A battery repair employee suffered an amputation of the tip of the right ring finger on April 17, 2015 when pulling battery cells out of a battery tray and the finger got pinched between the upward hoisted battery cells and the battery tray. The employer failed to report this work-related amputation to OSHA within 24 hours. (The employer reported this amputation to OSHA on April 20, 2015.)
