OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to engulfment and potential atmospheric hazards: a) On or about April 22, 2015, employees were exposed to potential engulfment and atmospheric hazards while working in a manure mixing area to remove two pumps that needed to be cleaned and repaired. Employees were preparing to enter a permit-required confined space without performing atmospheric testing, having the dry manure adequately shielded or shored from cave-in, and having an adequate non-entry rescue retrieval system.

29 CFR 1910.1200(h)(3)(iii): Employee training did not include the measures employees can take to protect themselves from chemical hazards, including specific procedures the employer had implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures and personal protective equipment to be used: (Agriculture Reference: 1928.21(a)(5)): The employer did not instruct all employees working in the milking parlors with Pre and Post Teat Dips on the correct personal protective equipment required. On or about April 22, 2015, an employee was observed working with the chemicals without proper eye protection.
