29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:  (a) 122 Walnut Bottom Road - The employer did not ensure that employees working on third story with an open side were protected from falls with guard rails, safety nets or personal fall protection, thereby exposing employees to a approximately 20 foot fall hazard on or about April 16th, 2015.   Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces shall be protected from falling through holes (including skylights) more than 6 feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes.  a)  122 Walnut Bottom Road, Shippensburg, Pa - Employees on the 3rd floor were exposed to a 28 x 16 unprotected hole located on the third floor, on or about April 16th, 2015.   No abatement certification or documentation required.

29 CFR 1926.502(d)(15)(ii): Anchorages used for attachment of personal fall arrest equipment shall be independent of any anchorage being used to support or suspend platforms and capable of supporting at least 5,000 pounds (22.2 kN) per employee attached, or shall be designed, installed under the supervision of a qualified person:  (a) 122 Walnut Bottom Road - The employer did not ensure that the anchor point located on the 3rd story floor was installed under the supervision of a qualified person,  thereby exposing employees to an approximately 20 foot fall hazard on or about April 16th, 2015.   (b) 122 Walnut Bottom Road  The life line was secured to the D ring of the anchor point with a knot. The employer did not ensure that the life line was properly connected to the anchor point on the 3rd story floor with manufacturers provided clip on or about April 16th, 2015.    Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards:  (a) 122 Walnut Bottom Road - The employer did not provide training to the employees which would have allowed them to recognize the hazards of falling and the procedures and equipment to minimize those hazards, thereby exposing employees to possible injuries, on or about April 16, 2015.  Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.503(b)(1): The employer shall verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training:  (a) 122 Walnut Bottom Road - The employer did not provide a written certification record of the training classes attended by the employees which would have allowed employee(s) to recognize the hazards of falling and the procedures to minimize those hazards, thereby exposing employees to possible injuries, on or about April 16, 2015.  Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
