29 CFR 1926.55(a): Employee(s) were exposed to material(s) at concentrations above those specified in the Threshold Limit Values of Airborne Contaminants for 1970 of the American Conference of Governmental Industrial Hygienists:    The employer did not protect employees from exposures to Silica Dust (Respirable Fraction) at concentrations in excess of the Permissible Exposure Limit while performing routine work activities:      a)    An employee operating the pavement router was exposed to an eight-hour time-weighted average level of 32.48 million particles/cubic foot, approximately 1.52 times the Permissible Exposure Limit of 21.27 million particles/cubic foot for Silica Crystalline Quartz (Respirable Fraction). The exposure level is derived from a sample collected over a 373 minute sampling period with zero exposure assumed for the unsampled period of time (107 minutes).

29 CFR 1926.55(b): Feasible administrative or engineering controls were not implemented to reduce employee exposure(s):      Employees were exposed to Respirable Silica Dust in excess of the PEL, while operating a pavement router, and the employer did not implement feasible administrative or engineering controls. When such controls were not feasible to achieve full compliance, protective equipment or any other protective measures were not used to keep the exposure of the employee within the limits prescribed.
