29 CFR 1926.55(a): Employee(s) were exposed to material(s) at concentrations above those specified in the Threshold Limit Values of Airborne Contaminants for 1970 of the American Conference of Governmental Industrial Hygienists: The employer did not protect employees from exposures to Silica Dust (Respirable Fraction) at concentrations in excess of the Permissible Exposure Limit while performing routine work activities: a) An employee operating the pavement router was exposed to an eight-hour time-weighted average level of 32.48 million particles/cubic foot, approximately 1.52 times the Permissible Exposure Limit of 21.27 million particles/cubic foot for Silica Crystalline Quartz (Respirable Fraction). The exposure level is derived from a sample collected over a 373 minute sampling period with zero exposure assumed for the unsampled period of time (107 minutes).
