29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards: A. On or about April 23, 2015, at the Arium apartment complex, an employee working from a scaffold to install windows was not trained to recognize scaffold hazards such as incomplete planking, inadequate guardrails, or excessive distance between the working surface and the front of the scaffolds.

29 CFR 1926.454(b): The employer did not have each employee who was involved in erecting, disassembling, moving, operating, repairing, maintaining, or inspecting a scaffold trained by a competent person to recognize any hazards associated with working from scaffolds: a. On or about April 23, 2015, at the Arium Apartment complex, an employee working from scaffolds that had been altered while installing windows had not been trained by a scaffold competent person to recognize hazards associated with incomplete planking, inadequate guardrails, and excessive distance between working surfaces and the front of the scaffolds.
