29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (a) On or about April 22, 2015, and at times prior, the employer had not developed a hazard communication program which addresses chemical labels and warnings, safety data sheets, employee information and training, a list of hazardous chemicals, and methods of training for non-routine tasks. Chemicals to which employees can be exposed include, but is not limited to, liquid petroleum gas (flammable, carcinogen), RMC Balma-Septic Antiseptic Handwash (eye, skin and digestive tract irritant; nausea, diarrhea, vomiting), and Floor Gard powdered floor cleaning treatment (severe eye irritation, skin and reparatory irritation). 29 CFR 1910.22(a)(2): Where wet processes were used, drainage was not maintained, and false floors, platforms, mats, or other dry standing places were not provided when practicable: a) On or about April 22, 2015, and at times prior, employees were exposed to slip and fall hazards in the production area where raw and wet chicken product on the floor caused slippery conditions. An employee had fallen resulting in a sprain, a strain and restricted work duty. Abatement Note: Abatement certification and documentation are required for this item (see enclosed "Certification of Corrective Action Worksheet"). Kassel Associated Industries Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.22(a)(2), which was contained in OSHA inspection number 989232, citation number 1, item number 1, and was affirmed as a final order on December 12, 2014, with respect to a workplace located at 4038 Dover Road in Colorado City, Colorado.

29 CFR 1904.7(b)(3): The employer did not correctly classify the following work-related injuries or illnesses on the OSHA Form 300 or equivalent: (a) On or about April 22, 2015, and at times prior the employer incorrectly classified case 3792498 on the 2015 Log of Work Related Injuries and Illnesses. It was marked as "Days away" and should have been marked as "Job transfer or restriction" because the employee returned to work the day after sustaining the injury and did not incur a lost day.
