OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees operating a forklift of a tipover hazard while operating on a sloped, uneven, dirt and gravel yard between storage buildings. On or about April 17, 2015, in the Yard on a sloped dirt and gravel ground, by an average of 5 degrees, between storage buildings, a forklift operator of a Komatsu sit-down propane forklift and exposed to a tipover hazard while operating a forklift without wearing a seatbelt while moving damaged skids from one area between the buildings to another to where they were being cut up and thrown in a dumpster. Among other methods, one feasible and acceptable method to correct this hazard is to follow the manufacturer's operating instructions and ANSI B56.1-2012, Safety Standard for Low Lift and High Lift Trucks, para 5.3.19, which states if an active operator protection device or system was provided, it shall be used.

29 CFR 1910.178(m)(5)(iii): When the operator of an industrial truck is dismounted and within 25 ft. of the truck still in his view, the load engaging means shall be fully lowered, controls neutralized, and the brakes set to prevent movement. On or about April 17, 2015, at the Yard, a forklift operator was exposed to a struck-by, caught-inbetween hazard while he dismounted the Komatsu forklift still under power and fell to the ground without fully lowering the tines and setting the brakes to prevent the movement of the forklift.
