29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor  did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.  The employer does not protect employees from falling when working 6 feet or more above lower levels. This violation was observed on or about April 21, 2015 at the construction site where an employee was exposed to a 10 ft. fall hazard when performing roofing work without fall protection. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are protected from falling when exposed to falls 6 feet or more above a lower level or ground.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access.  The employer does not ensure that ladders used by employees are extended 3 feet above the upper landing surface. This violation was observed on or about April 21, 2015 at the residential construction site where employees were exposed to falls of approximately 18 ft. and 9 ft. when using a ladder that was not extended 3 feet above the upper landing surface.
