OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to falls:   a)     At the worksite employees accessed upper levels by standing on a bundle of sheathing being lifted by a rough terrain forklift. The employees were exposed to a fall of 23 feet to the ground.

29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets.     a)     At the worksite, employees were not provided  hard hat protection while working below employees working above their head, thereby exposing employees to a potential struck-by hazard.

29 CFR 1926.501(b)(14): "Wall openings." Each employee working on, at, above, or near wall openings (including those with chutes attached) where the outside bottom edge of the wall opening is 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 m) above the walking/working surface, shall be protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system.     a)     At the worksite, employees were working by an unguarded wall opening, thereby exposing employees to an approximately 15 foot fall hazard.

29 CFR 1926.503(c): "Retraining." When the employer has reason to believe that any affected employee who has already been trained does not have the understanding and skill required by paragraph (a) of this section, the employer shall retrain each such employee. Circumstances where retraining is required include, but are not limited to, situations where:  29 CFR 1926.503(c)(3): Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill.     a)     At the worksite, employees did not have a clear understanding of hazard recognition and avoidance associated with the requirements to use fall protection when working at heights greater than six feet.  b)     At the worksite, employees did not have a clear understanding of hazard recognition and avoidance associated with rough terrain forklift work platforms.

29 CFR 1926.1052(c)(1): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, shall be equipped with:  29 CFR 1926.1052(c)(1)(ii): One stairrail system along each unprotected side or edge.     a)     At the worksite, the stairway going from the first floor to the landing area was not equipped with a stair rail system along the open side, thereby exposing employees to a potential trip/fall hazard.

The path to ground from circuits, equipment, and enclosures shall be permanent and continuous.     a)     At the worksite, where an extension cord was used to supply power to a generator that was supplying power to portable power tools such as, but not limited to circular saws and nail guns, the ground prong of the extension cord was missing, exposing employees to a potential contact/shock hazard.    Modern Way Framing was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.404(f)(6), which was contained in OSHA inspection number 314592635, citation number 1,  item number 1, and was affirmed as a final order on May 24, 2011, with respect to a workplace located at 746 Elderberry Loop, Delaware, Oh 43015.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.     a)     On the site where framing work was taking place on the roof area, employees were not provided and did not use fall protection when working at heights greater than six feet, thereby exposing employees to an approximate 23 foot fall hazard.
