29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace    a) On or about 4/20/2015 and at times prior thereto, Brand Energy Services employees working at the TVA Plant located at 1499 Steam Plant Road in Gallatin, TN were provided a 1/2 face air purifying respirator, for protection from dust while cutting insulation, and was not provided a medical evaluation to determine the employee's ability to use a respirator.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.134(m)(1): Records of medical evaluations required by 29 CFR 1910.134 were not retained and made available in accordance with 1910.1020.  a) On or about 4/20/2015 and at times prior thereto, Brand Energy Services employees working at the TVA Plant located at Steam Plant Road in Gallatin, TN were provided a 1/2 face air purifying respirator, for protection from dust while cutting insulation, and did not maintain medical records of employees wearing respirators.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
