OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushed-by hazards:  a)  Mead West Vaco rail yard; On or about April 14, 2015 and at times prior the employer failed to ensure employees did not leave the cab of the New Holland skid steer without ensuring all steps required prior to leaving the equipment were followed (Parking brake engaged, Bucket/Attachments lowered, Engine turned off).

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:  On April 14, 2015 the employer exposed employees to fall hazards of up to 4ft while using a 6ft a folding portable fiberglass ladder to access the railcars being cleaned. The ladder was not on level ground nor in its open and locked position, instead the ladder was leaned against the railcar. Further the ladder that was in use had damage to its back side rail that would require it be taken out of service until repaired.

29 CFR 1910.157(c)(4): Portable fire extinguishers were not maintained in a fully charged and operable condition:  (a) Skid steer on the rail yard: On or about April 14, 2015: the employer failed to ensure that the fire extinguisher mounted on the skid steer was charged and available for use in event the employee needs to use it to exit the equipment in the case of a fire.

29 CFR 1910.253(b)(4)(iii): Oxygen cylinders in storage were not separated from fuel-gas cylinders or combustible materials (especially oil or grease), a minimum distance of 20 feet (6.1 m) or by a noncombustible barrier at least 5 feet (1.5 m) high having a fire-resistance rating of at least one half hour  a) Shed near railroad tracks; On or about April 14, 2015 and at times prior thereto the employer exposed employees to fire hazards in that employees were allowed to walk and work in the same area where oxygen cylinders and fuel gas(Propane) cylinders were stored together without a barrier as required by the standard.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  a)  Facility wide; On or about April 14, 2015 and at times prior thereto the employer exposed employees to hazardous chemicals and substances that include but are not limited to Oxygen, Propane, and Diesel Fuel used in the repair of train cars without providing information and training on these chemicals and substances as required by the standard. In addition employees have not been trained on the global harmonized revisions to the hazard communication standard.
