29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE):    On or about April 22, 2015, and at times prior thereto, at this facility, employees engaged in recycling activities were exposed to hazards, such as, but not limited to, foreign objects in the eyes, eye and skin irritation, eye burns, lead, calcium hydroxide, cadmium, asbestos, chlorodiphenyl (54%), and arsenic.  The employer did not perform an adequate assessment to determine the need for personal protective equipment (PPE), such as, but not limited to, safety glasses, chemical goggles, welding safety glasses/shield, protective clothing, and appropriate gloves, i.e., chemical, welding, leather.

Nissan 50 Optimum, Chassis Number CPJ02-9P1454, Model CPJ02A25PV,  b.  Komatsu, Serial Number 553564A, Model FG30SHT-12, and   c.  Komatsu, Serial Number 507114A, Model FG30SHTLP-12.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    At this facility, employees engaged in recycling activities were exposed to hazardous chemicals, such as, but not limited to, calcium hydroxide, lead, arsenic, cadmium, asbestos, and chlorodiphenyl (54%).      The employer has not developed a program which would address labeling, safety data sheets, other forms of warning, and employee information and training on the hazards associated with the hazardous chemicals at this site.    The written program should also contain the following:       a.  a list of all hazardous chemicals onsite,       b.  the methods the employer will use to inform and train employees of the hazards of non-routine tasks and the known associated hazards,       c.  the hazards of chemicals onsite, and       d.  establish procedures to evaluate the effectiveness of the program.
