29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    Cherokee Tribal School Maintenance Dept.: A landscaping equipment operator was exposed to continuous noise at 80.43% of the permissible daily noise exposure (8 hour time weighted average sound level of 85dBA) or an equivalent sound level of approximately 88.4 dB during the 244 minute sampling period on April 23, 2015; exposure calculations included zero increment for the 236 minutes not sampled.      ABATEMENT DOCUMENTATION REQUIRED

29 CFR 1910.95(g)(1): The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels:  Cherokee Tribal School Maintenance Dept.: An employee was not subjected to audiometric testing after being exposed to noise levels above 85 decibels as 8 hour time weighted average. 29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program:    Cherokee Tribal School Maintenance Dept.:  Where employees are being exposed to noise in excess of 85 decibels while performing grass cutting operations, a noise monitoring program was not developed and implemented.      ABATEMENT DOCUMENTATION REQUIRED    The U. S. Department of Interior was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.95(d)(1): which was contained in OSHA inspection number 943885, Citation 2, Item 1 and was affirmed as a final order on 12/24/2013, with respect to a workplace located at 130 Ravensford Drive, Cherokee, NC 28719.

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE):  Cherokee Tribal School Maintenance Dept.:  The employer did not develop a written workplace hazard assessment for personal protective equipment such as, but not limited to safety glasses, hearing protection, gloves, safety shoes, respirators etc., for each specific job task relating to school maintenance.    ABATEMENT CERTIFICATION REQUIRED  The U. S.
