29 CFR 1910.120(q)(6)(iii): Employees who participated as hazardous materials technicians, or were expected to participate as hazardous materials technicians, had not received at least 24 hours of training equal to the first responder operations level, and in addition have competency in the areas outlined in 29 CFR 1910.120(q)(6)(iii)(A) through (q)(6)(iii)(I) and/or the employer did not so certify: a) At the facility, on or about 5-6-2015: The technician was trained only at first responder 8 hour operations level, and was doing tasks including but not limited to active spill containment and clean-up of spills of toxic, corrosive or flammable materials; and was doing day to day collection, labeling and potentially spill cleanup for diverse hazardous waste streams including the treatment, neutralization of wastes. Abatement certification must be submitted.

29 CFR 1910.120(q)(6)(v): Incident commanders did not receive at least 24 hours of training equal to the first responder operations level and in addition have competency in the areas outline in 29 CFR 1910.120(q)(6)(v)(A) through (q)(6)(v)(F) and/or the employer did not so certify: a) At the facility, on or about 5-6-2015: The Emergency Coordinators were trained at First Responder Awareness Level however they managed emergencies including but not limited to active hazardous materials/waste spills; they determined the magnitude of the problem, set initial exclusion zones and evacuation plans and then as appropriate either called outside responders or managed in house spill clean up tasks: containment and clean-up of toxic, corrosive or flammable materials/waste spills. Abatement certification must be submitted.

29 CFR 1910.132(a): Protective equipment, including personal protective equipment for the extremities was not provided and used wherever chemical hazards are encountered that are capable of causing injury or impairment in the function of any part of the body through absorption or physical contact. a) At the plating department, on or about 5-6-2015: Employees were exposed to corrosive and toxic plating solutions, and used Tyvek disposable lab coats; which are not rated for moderate liquid chemical splash or liquid chemical splash of toxics and corrosive chemicals (b)At the plating department, on or about 5-6-2015: The plating employee standing at the baths was not using the butyl /neoprene aprons as required in the company hazard assessment. Abatement certification must be submitted.
