29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights) more than 6 feet (1.8m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes: a) Floor holes were not protected. There were two holes in the stairway used by employees to access the work areas. Employees can trip or catch their foot in a hole. b) There was a 15 inch deep hole in the ground near the foot of the stairs. The unprotected hole was 2 ft wide and had a board placed over it which did not provide floor hole cover protection. Location: 360 Neptune Ave, Brooklyn, N.Y. On or about 4/1/2015 NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASEFILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION NOR DOCUMENTATION OF ABATEMENT OF THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.1052(c)(12): Unprotected sides and edges of stairway landings were not provided with guardrail systems: a) Fall protection (cables or guardrails) was not provided at the 4th and 5th floor stair landings. Employees were exposed to 40 ft fall hazard. Location: 360 Neptune Ave, Brooklyn, N.Y. On or about 4/1/2015 NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASEFILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION NOR DOCUMENTATION OF ABATEMENT OF THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.
